The passage of the East Pacific Police Service Act:

East Pacific Police Service Act
 
Preamble

An organization of nations dedicated to protecting The East Pacific's sovereignty by marked and undercover operations into Law Enforcement, as well as domestic and international intelligence.

Section 1: Citation

This law may be cited as the Eastern Pacific Police Service Act.

Section 2: General Provisions

The Eastern Pacific Police Service (EPPS) is hereby established, and its powers and responsibilities are hereby defined as:

...2.1- Protecting The East Pacific's regional sovereignty on a local basis.
...2.2- Domestic and international intelligence operations.
...2.3- Collaborating with the Eastern Pacific Sovereign Army on regional defense and intelligence operations.
...2.4- Assisting the Conclave in evidence gathering and intelligence in court cases.

Section 3: Command

...3.1- The Eastern Pacific Police Service shall be overseen by a Commissioner who is nominated by the Delegate and confirmed by majority vote in the Magisterium.
.......3.1.1- The Commissioner shall undergo a confirmation vote in the Magisterium, each time a new Delegate is elected. Such a confirmation vote should take place at least each 6 months.
.......3.1.2- If the Commissioner-nominee is not confirmed, the Delegate must nominate a new Commissioner through the process described in Section 3.1
...3.2- The Commissioner can be removed by a majority vote of the Magisterium for inactivity, high crimes, treason, or inability to perform his/her duties.
...3.3- The Commissioner shall oversee and be responsible for all activities of the EPPS.

Section 4: Structure

...4.1- The Commissioner may utilize any organizational structure which allows the EPPS to achieve the responsibilities in Section 2, and does not violate the Concordat or the laws of The East Pacific.

Section 5: Investigations

...5.1- The Eastern Pacific Police Service shall, as the primary investigative service for The East Pacific, adhere to these restrictions:
.......5.1.1- All investigations of citizens of The East Pacific must be approved by the Viceroy of the Conclave unless it is an investigation of an Arbiter, in which case the investigation must be approved by either the Delegate or the Provost.
.......5.1.2- All investigations of citizens of The East Pacific must be announced on the forum, unless the Commissioner and the approver document reasons that the investigation can only be conducted covertly. Such documentation must be posted on the forum at the conclusion of the investigation.
.......5.1.3- All investigations of foreigners must be approved by the Viceroy of the Conclave, unless the nation in question is a citizen of a region at war with The East Pacific, in which case no approval is required.
.......5.1.4- Investigations of foreigners do not need to be announced in the forum.

SECTION 6. Enactment

This bill shall be enacted upon its signature by the Delegate, except if the Magisterium votes to override a veto of this bill by the Delegate.

The passage of the East Pacific News Service Act:

The Eastern Pacific News Service Act
 


Section 1: Citation

This law may be cited as the Eastern Pacific News Service Act (or EPNS).

Section 2: Responsibilities

The EPNS is charged with issuing a newspaper on the forums of The East Pacific, NationStates and all regions with which we have embassies at least once a month, starting on the 1st week after the passage of this Act.

Section 3: Leadership

...3.1- The Eastern Pacific News Service shall be overseen by an Editor who is nominated by the Delegate and confirmed by majority vote in the Magisterium.
.......3.1.1- The Editor shall undergo a confirmation vote in the Magisterium, each time a new Delegate is elected. Such a confirmation vote should take place at least each 6 months.
.......3.1.2- If the Editor-nominee is not confirmed, the Delegate must nominate a new Editor through the process described in Section 3.1
...3.2- The Editor can be removed by a majority vote of the Magisterium for inactivity, high crimes, treason, violation of the standards in Section 5, or inability to perform his/her duties.
...3.3- The Editor shall oversee and be responsible for all activities of the EPNS.

Section 4: Organization

The Editor may utilize any organizational structure which allows the EPNS to achieve the responsibilities in Section 2, and does not violate the Concordat or the laws of The East Pacific.

Section 5: Content

...5.1- The articles should be in good taste and not be terribly harsh.

...5.2- The standard is the US movie rating "PG-13". Mild swearing may be tolerated, mild sexuality may be hinted, but explicit or excessive versions of either or both may result in the removal of the Editor from the EPNS.

...5.3- Keep it Civil. While being abrasive, mean-spirited, and mean are not in violation of the Concordat, they are grounds for removal of the Editor from the EPNS. When in doubt, a simple guideline is "Don't Be A Dick."

...5.4- While Article F, Section 1 provides for the right to free speech for all citizens in The East Pacific, and the Editor retains this right while engaging in speech outside of the EPNS, the Editor must follow the content guidelines of section 5 of this Act while performing duties as Editor.

Section 6: Enactment

This bill shall be enacted upon its signature by the Delegate, except if the Magisterium votes to override a veto of this bill by the Delegate.

The passage of the Consolidated Endorsement Cap Act:

BE IT ENACTED by the Magisterium of the East Pacific:

SECTION I. SHORT TITLE

This act shall be known and cited as the "Consolidated Endorsement Cap Act."

SECTION II. FINDINGS

The Magisterium finds that --

(1) The process of influence accumulation in NationStates has changed and a nation's influence will be based on the nation's endorsements and activity only over the previous 6 months;

(2) Recent stability in The East Pacific has been achieved because many citizens have retained high levels of influence; and

(3) Endorsement caps provide both stability and security for the region.

SECTION III. DEFINITIONS

For the purposes of this act --

(1) "East Pacific nation" means any nation within The East Pacific region, in particular, regardless of whether it has the status of citizen or has ratified the Concordat; and

(2) "Lawful authorization" means an authorization granted by the Delegate under the laws of the East Pacific; and

(3) "Endorsement cap" is a limit on the number of endorsements that an East Pacific nation may accumulate; and

(4) "Non-Delegate-friendly endorsement cap" is a limit on the number of endorsements that an East Pacific nation may accumulate if that nation has not endorsed the Delegate; and

(5) "Primary endorsement cap" is a limit on the number of endorsements that an East Pacific nation may accumulate if that nation has endorsed the Delegate; and

(6) "Secondary endorsement cap" is a limit, higher than the primary endorsement cap, on the number of endorsements that an East Pacific nation may accumulate if that nation has received lawful authorization from the Delegate.

(7) The non-Delegate-friendly endorsement cap is set at 15.

(8) The primary endorsement cap is set at 120.

(9) The secondary endorsement cap is set at 150.

SECTION IV. REPEAL OF PREVIOUS LEGISLATION

Both the Endorsement Cap Act (passed March 30, 2009) and the Secondary Endorsement Cap Reform Act (passed October 6, 2010 and amended March 27, 2011) are hereby repealed and replaced with the Consolidated Endorsement Cap Act.

SECTION V. PROVISIONS

(1) The Delegate must display the current numerical value of the non-Delegate friendly and the primary endorsement caps on the region's world factbook entry.

(2) The Delegate and the Viziers are not subject to the provisions of the Consolidated Endorsement Cap Act.

(3) Any change of the endorsement caps (non-delegate-friendly, primary, or secondary) must be approved by the Magisterium and shall be effective when the approval vote is completed.

(4) The Delegate may choose to grant the secondary endorsement cap privilege to increase the security of the region by increasing the influence of citizens who have demonstrated loyalty and stability to The East Pacific. The Delegate shall create a thread in the Executive section of The East Pacific forum where citizens who have received this privilege are listed.

SECTION VI. VIOLATIONS OF ENDORSEMENT CAPS

(1) Any nation having a number of endorsements in excess of the endorsement cap to which it is subject, commits an unlawful act.

(2) Any nation soliciting additional endorsements beyond the endorsement cap to which it is subject, commits an unlawful act.

(3) Any nation in violation of this act can be advised by the Eastern Pacific Police Service, the Delegate or a designee of the executive to reduce the number of endorsements below to the endorsement cap to which it is subject.

(4) Any nation, having been advised in accordance with (3) and maintaining a number of endorsements in excess of the endorsement cap to which it is subject, may be summarily ejected from the East Pacific for not more than 48 hours.

(5) Any nation, soliciting additional endorsements beyond the endorsement cap to which it is subject, commits an indictable offense and may be summarily ejected and banned from the East Pacific for up to 1 year.

(6) Any offense and punishment legislated in this act does not in any way diminish the enforcement of the offenses described by the Treason act, nor the prerogative of the Delegate or executive to prosecute any unlawful act as offenses under the Treason act should these be applicable.

SECTION VII. ENACTMENT

This bill shall be enacted upon its signature by the Delegate, except if the Magisterium votes to override a veto of this bill by the Delegate.

BE IT ENACTED by the Magisterium of the East Pacific:

SECTION I. SHORT TITLE

This act shall be known and cited as the "Concordat Supremacy Act."

SECTION II. FINDINGS.

The Magisterium finds that --
(1) The laws of the East Pacific ought to apply to all nations that ratify the concordat
(2) Real life location and medium of communication ought not to be an obstacle to the rule of law
(3) Forum administration remains unimpeachable
(4) The Concordat is the Fundamental and Supreme Law of The East Pacific
(5) All nations residing in The East Pacific may freely ratify the Concordat either by posting a ratification in the designated ratification thread, or by submitting the designated ratification form.
(6) The Confederated East Pacific is an international body consisting of all nations whose ratification of the Concordat remains in effect.
(7) All nations that ratify the Concordat are forever bound to it and answerable to the Conclave for committing any crimes as defined by the laws that are enacted by the legislature that the Concordat has established.
(8) Ratification can only be undone by a public renunciation of the Concordat, and members who renounce their ratification will forfeit their TEP citizenship.
(9) The official forum of The East Pacific is housed at http://www.theeastpacific.com/
(10) 1 Infinite Loop (Founder and Creator), Packilvania (Owner and Curator), East Malaysia (Maintainer and Improver), and Todd McCloud (Frice World Assembly Delegate) are recognized as administrators of theeastpacific.com

SECTION III. DEFINITIONS.

For the purposes of this act --
(1) "The Concordat" is the Concordat of The East Pacific which is subject to amendments by due process; and
(2) "The East Pacific" is a region in a fictional multiverse whose Regional Headquarters and World Factbook Entry is located at http://www.nationstates.net/region=the_east_pacific/ and whose regional forum is located at http://www.theeastpacific.com/

SECTION IV. PROVISIONS.

(a) Administrative and moderation matters of theeastpacific.com that are reserved by the administrators are exempt from the provisions of this act.

(b) Where a gathering under the name of The East Pacific includes two or more citizens, they are governed by laws and Concordat of The East Pacific.

(c) Any gathering of nations or players associated with TEP may petition the Magisterium for exemption from this act, which may be granted by the enactment of either a new law or an amendment to this law adding provision for a gathering that should be exempt from the rule of law.


SECTION V. ENACTMENT.

This bill shall be enacted upon its signature by the Delegate, except if the Magisterium votes to override a veto of this bill by the Delegate.


The Magisterium asks the Delegate and the Executive to take all necessary measures to execute this Act, unless vetoed within 10 days.
