The General Assembly: Noting that freed inmates have already paid the legal consequence for their action, and therefore ought to be, rather than shunned out of society, reintegrated into it, Believing that the right to vote ought not to be arbitrarily deprived from individuals due to such factors as prior criminal status that do not impede one's mental competency, Concerned especially for the innocently convicted, who, through felon disenfrachisement laws, are unfairly deprived of voting rights for a crime they did not commit, Asserting, therefore, that the disenfranchisement of former criminals constitutes unjust discrimination that must, in the name of civil equality, be addressed by this Assembly: 1. Prohibits member nations from denying a non-imprisoned, otherwise-eligible individual the right to vote on an equal basis with any other voter solely on account of their prior criminal activity, unless any of the following is true: a. said criminal activity directly pertained to any of the following crimes: i. voter fraud or other related acts, ii. improperly aiding a foreign or domestic power in the subversion of the nation, b. said person is on either parole or probation for a previous crime, 2. Prohibits member nations from enacting measures that would excessively impede the right of an otherwise-eligible former criminal from voting, 3. Reserves for member nations the liberty to legislate on the issue of enfranchisement for individuals under incarceration. |

To start with, I'd love to congratulate United Massachusetts as a member of the Ministry of World Assembly Affairs on getting a well-written proposal through to quorum! Best of luck on its success. However, I will be voting against, and I advise others do so as well. I feel a blanket protection to former prisoners throughout all World Assembly member nations is neither fitting nor fair considering the nature of criminality and the diverse perspectives on such matters expressed throughout each nation. Some states, Verdrassil included, would argue an individuals right to vote is ultimately forfeited after committing certain acts of criminal nature. I'm quite disappointed by how limited the restrictions put forth by Section 1.a. prove to be, as the resolution seems to extend an opinion that those who have commented particularly violent or heinous crimes are of sound mind to vote for national affairs. I also worry that since this resolution applies to the formerly incarcerated, nations might feel the need to exacerbate their penal codes in order to keep individuals imprisoned longer (or extend the duration of probation) so their right to vote remains diminished. This, in essence, might ultimately subvert the author's original intentions to promote "civil equality". Edited by Drachen, Dec 31 2017, 09:43:54 PM.

The Queendom has voted for this resolution. I do appreciate and also agree with points outlined by Drachen, but my concern is that by continuing to ban all of the rights of those previously incarcerated, each nation is effectively marginalising an entire group. This does not allow for a fair democratic process to occur within nations. In terms of effectively rehabilitating criminals, withholding their right to chose government could have negative effects on that process, specifically for first time & minor offenders. The purpose of the rehabilitation process is to reintegrate criminals to be effective and contributing members and to reduce the likelihood of reoffending. Withholding the right to vote sends a message of distrust to the formerly incarcerated and may increases the likelihood of reoffending. I would however like to see a clause that withholds the right to vote from a specific range of offenders who have committed serious and heinous crimes. I am sure this could be passed as a separate bill itself though. |
