[OOCRP]Motion for apeal to RP mod decision

I would like to start a discussion on the recent decision to stop RP based on one members non-emergency happenings. Whilst I am more than willing to slow an RP to allow members to get back into the swing, I beleive completely stalling the RP will lead to an RP's death as it has proven to do in the past.

To start off, this doesn't go in the Appeals Court. Its an RP decision, which is seperate. I'll leave it here, anyway, though, as...well, frankly, I shouldn't be moderating a topic that is questioning my moderation.

Moving on. As per RP Moderator's Office Procedure, the next person in the appeals chain is Global Moderator Codex (Picked due to his near inactiveness in RP, yet simultaneous knowledgability about it). He is, of current, inactive.

As such, the decision automatically moves on to the next appeal, the Wachovia Coalition.

At this point, it is 1:22 AM my local time. Before you make a decision, Wachovia, I ask that you allow me to present a full argument on my behalf, come morning, when I can actually think.

Of course, you don't have to. You can just rule against me. But I'd like to give my side before you make a ruling. And I also wouldn't be adverse to Pack giving a more formal position as well, if he'd like.

Well it could go to the Appeals Court, if you think about it. The RP guidelines law thing (which are like stalled in the Assembly w/. alot of other bills) are being discussed by the Assembly and it really should be a RP Mod issue/decision, but it's in the Assembly. So why cant the Appeals Court handle a RP issue also? The Assembly does it... well from my point of view it does. I could be wrong, but this is how i see this situation.

Well, EM, until that bill is passed (which, at least I hope, isn't soon, as I disagree with its primary objective and its terms), the RP Moderator's Office is just that: A moderator's office. This is a site administration deal, not a government deal. Sure, Loop has combined the two at points, but of yet, my office remains only that of a moderator, not that of a cabinet member.

Nonetheless, if ya'lld like, I could fit the appeals court in. It doesn't really matter, seeing as, normally, Codex would be the one a person first appeals to. It just doesn't have legal backing.

Anyways...

Point One: Initial Reasoning

Govindia has stated that he will be unable to return to RP until Saturday as a result of an emergency. As such, he has requested that a temporary hiatus be placed on all RP activities involving him (which is pretty much all RP activities), that he is not left behind, or left with like 5 pages of RP to write when he returns.

As RP Moderator, I, of course, looked over his request, and the affects of trying to post without him. They were not good. In almost everyone RP hes involved in, Govindia is playing a major part. In most of them, his post is actually required for a continuation of the RP. Now, in the mind of those proposing to appeal my decision, his position in the RP would just be..circumvented. I'm not sure exactly how that would be done, but however it would be done, I am quite positive it would either leave the storyline in an extremely weird position, taking loops and curves it doesn't need to, or leave it with large holes wherever Govindia should have responded.

On top of this, as a moralistic person, I found I had to approve the hiatus. Realizing he has a major RL emergency he must deal with, he asks...pleads for the RP community of the EP to hold up, not to leave him behind. As Wachovia put it...why can't we cut him a little slack? Hes having an emergency, and all we can think about is how to keep going without him.

Finally, back as RP Moderator, I didn't like the precedant that would be set. If his hiatus is not approved, the EP site administration will be stating that this board is more important then RL emergencies, and that, should such an emergency exist, you should just ignore it, to keep your place here.

Come on, people. Hes going through a real emergency, and all people want to do is say "Sucks for you" and keep going. I'm sorry, but outside of destroying those RPs hes in, and being entirely moralistically wrong, it sets a precedent that I cannot, and will not agree with.

Point Two: Response to Appeal

I've already adressed that it is an emergency that is pulling Govindia away. Thus goes the first part of your argument. As for the second...you state that you'd be willing to slow RP, but not stop it. And you state that the RP might die if you stop it.

Well, Pack, so be it, if you ask me. I don't want the RP to die, and over the course of three days, I doubt it will. But frankly, if it comes to having a crappy plot, with a large hole where Govindia should have posted, versus not having a storyline at all...I'd choose the latter. But thats just me.

I rest my case, and do hope you will back it, Wachovia.

Given the recent arguments FPS has given, I must agree with him. I would like to retract my second motion to appeal his RP decision, and stand in favor of such decision. As such, I will discontinue RPing immediately, until Govindia becomes available once again. Sorry, Pack.

As our legal system hinges on the actions of a mod now in absence and a mod involved in this appeal, this will need to fall to the admin's. I won't comment on future practice except to say that new legislation is needed to link appeals like this to the regional courts if the region feels that is wise.

Thank you all for presenting the material this far. Please allow me five hours to respond to this matter. It is possible I can have a quicker response but it would be unwise for me to promise that.

Until this verdict is complete, please restrain yourself from advancing RP threads that require interaction between your nation and Govindia. Notably, Imatron's thread illustrates an exception this rule.

I have moved this thread here for the time being as it is only appropriate in this section. Upon completion, I can archive it so that FPS has no mod connection with it. That being said, I obviously have no concern FPS will or can alter facts in such a way that will stop these proceedings in a significant way.

Initial thoughts
Before I give my offical announcement, let me say that I am disapointed at what I have waded through in the past day as I've tried to get some sense of this mess.

I have seen each of you contribute good things to this region so I have no qualms about your general abilities and I trust many of you well. That said, there has been a building tension between players that has spilled into RP. Increasingly, IC policy is determined by OOC silliness. That's poor RP. I don't expect that we become Vulcans but the EP has made it practice to show some measure of respect to our enemies even. How much more should we respect each other despite our obvious differences.

I'm also very frustrtated with a few that will be spoken privately to about use of our forums. IC goes in Inwardly Angled; OOC goes in here. I'm about ready to supercede FPS, talk to Loop and make that strict policy. I hope it doesn't come to that.

Lastly, respect the mods please. They are hardly perfect but here's a tip. Ask ONCE and then wait. If they don't respond stop and think. "Does this mean they are ignoring me because I'm asking a silly question?" If you feel you still need an answer send them ONE private message and wait. If you don't hear back in a week then stop and think. "Is this a major issue?" If it is, approach me about it and politely ask about it. You will not get your way often. Get used to it. It's compromise.

In the end, one person or two people will not sink RP or the heart of this region. I may be busy but I will not allow that to happen.
