Notice of Ejection and Ban; The Bombastic Republic of East Shlibobia

At approximately 1350 UTC, Tuesday, February 20, 2007, the nation East Shlibobia was ejected and banned from the region for seeking an endorsement count higher than that of the Delegate's. The number of endorsements the nation held at the time was 55.

Due to the severity of this crime, the Delegate has no intention of removing the ban, under the ultimate authority of the Charter of the East Pacific (Chapter 1, Section 1, Subsection 1), and in part, the Revised Endorsement Restriction Act (Chapter 3, Section 7, Subsection 2).

The East Pacific Charter
 
1.      The delegate shall have ultimate control over membership of the region, and shall have the power to remove from the region any nation seen to be in contravention of this charter or subsequent laws passed by the legislative branch.

(2) Any person found to be endorsement swapping is guilty of an indictable offence and is liable to be banned from the East Pacific for life.

As per Chapter 2, Section 2, Subsection 3 of the East Pacific Charter, under the authority given to the Viceroy in Chapter 1, Section 3, Subsection 1 of the East Pacific Charter, I am hereby invalidating the Delegate's permanent ban of East Shlibobia. A temporary ban may remain in effect until that time at which a proper trial has been held for East Shlibobia.

The East Pacific Charter
 
1.      The Regional Court is empowered to make rulings on the actions of the delegate as executor of this charter, and to support them or declare them void, in which case they may instruct the delegate to repeal such actions.

3.      That each nation shall have the right to full and unbiased trial by the Judicial Branch in the event of any action being taken against them by the regional authorities, or in the case of any accusation being levelled against them.


At this time, I would like to ask that the Chief Barrister of the Regional Court (Kangawara) locate a barrister to act in East Shlibobia's defense (and inform me once such a person is located). The Delegate is more then welcome to do so for the state as well. If the Chief Barrister cannot find such an attorney, I would ask that she step forward to take the job herself.

I will immediately set up the thread for the EP Bar Association, and ask for volunteers. In the event that we do not have a volunteer by Thursday, I would be more than willing to represent the defendant.

Your honour, the Government requests time to locate and appoint an Attorney General and a Solicitor General. If a Solicitor General cannot be located and appointed, I would ask that the Attorney General serve as the prosecuting attorney. If an Attorney General cannot be located and appointed, I would ask that the Chief Barrister of the Regional Court locate a barrister to act as the prosecuting attorney, upon request by the Government.

Excellent. Good luck, Barrister.

At this time, I'd ask that you contact your client, and ascertained whether s/he would like to fight the ban. If so, let me know, and begin preparing for trial (letting me know when you are ready). If not, let me know, and the ban will remain in effect.

Gnidrah, you have until that time at which the defense is prepared to go to trial to find an attorney to represent the state.

Thank you for your offer, BPC. It is good to see there are East Pacificans willing to step up and take on the duties of this region.

That said, I'm afraid it is not my call to make. The state decides who represents it in court. As such, you'll have to talk to Gnidrah.

We are, your honour. The Attorney General will be serving as the prosecuting attorney, on behalf of the State. At this time, your honour, the Government requests a closed session, as is permissible under the Charter of the East Pacific (Chapter 1, Section 3, Subsection 6).

6.      The delegate or Consul of the Assembly may, in the interests of regional security, request to the presiding judge that a closed session by held, whereby the judge may permit that the session or certain parts of it be held in private.

As Defence Counsel, I have absolutely no reason to believe that I have been lied to by my client, nor from what I have been told that this in any way involves regional security.

Your honour, the defense is apparently unaware of the prosecution's evidence, which was obtained from a mechanism crucial to the security of the region. It is because such evidence does not need to be entered into public record that the Government seeks a closed and private session.

There is no "apparently" about it. The defence is most certainly unaware of such evidence, nor would I expect to be aware of such unless I had been told ahead of time. If it is possible that I may be made aware of such evidence, in Chambers, it is likely that I will withdraw my objection. Until then, my objection stands.

Well, since both the State and the Defense seem to have no problem with the concept of a closed trial, I have no problem with the concept of a closed trial.

The trial will be held in the "Restricted Area," the password for which I am currently resetting. Once it is reset, I will PM the password to both the Attorney General and the Defense Counsel.
