[DEFEATED] Care of Magical Creatures Act

The World Assembly,

Acknowledging that the protection of wildlife is an important responsibility of member state governments,

Applauding previous attempts by the General Assembly to ensure the ethical treatment of non-sapient creatures, including GARs #290, 403, 489, 662, and 719,

Further noting that the protection of creatures of supernatural origin require additional regulation based on the specific needs and challenges associated with protecting and monitoring these creatures,

Concerned that without further protections, magical creatures across all member states may one day become extinct and their majesty and beauty will no longer be enjoyed,

Believing Magical Creatures require additional protections as, due to their magical properties and abilities, they are hunted and poached more severely when compared to other species,

Therefore, this proposal enacts:

Defines

    Defining Magical Abilities as abilities or talents that a non-sapient creature possesses which cannot be explained simply by science. These include, but are not limited, to a) miracles that heal diseases or sickness beyond the scope of medicine; b) influence over the laws of physics or nature in ways deemed supernatural; c) ability to supernaturally infuse mundane objects with properties or abilities to enhance their qualities; or d) the ability to resurrect dead individuals or creatures.

    Defining Magical Creatures as a non-sapient creature which innately posses Magical Abilities. These abilities can be from birth or bestowed upon the from an outside source.

    Defining Byproducts of Magical Creatures as anything that comes from the body of a Magical Creature that is reused for other purposes. These uses can be mundane or magical in nature.

Subject to existing member state and General Assembly regulations for the hunting of non-sapient animals and / or creatures, if hunting of Magical Creatures is legal within a member state said member state must task an organ with the monitoring of hunting Magical Creatures. Said member state organ shall ensure that any hunting program includes specific training on Magical Abilities of native Magical Creatures

Member states shall ensure proper regulations in sales and distribution of Byproducts including, at minimum, the following:

    A member state organ shall track all different Magical Creatures Byproducts from native Magical Creatures as well as consumable goods made using those Byproducts ensuring an equilibrium of the Byproduct supply and consumer demand.

    Prohibiting the sale of Byproducts and corresponding consumable goods from any Magical Creature defined as endangered by member state law except that which can be collected in a non-lethal manner.

    Ensuring that illegal stores and supplies of Byproducts are seized and controlled, and that illegal markets of said Byproducts or consumable goods are disbanded whether through hefty fines, imprisonment, or both.

Member states must establish specially designated Natural Magical Creature Reserves (Reserves) maintained by their Natural Resources or equivalent agency that is dedicated to ensuring a stable healthy population of Magical Creatures. Member states must ensure the following for all Reserves:

    Prohibit hunting on Reserves.

    Only specific Magical Creatures or flora / fauna used to feed said Magical Creatures shall inhabit the Reserve.

    All efforts shall be implemented to minimize the cross-breeding of Magical Creatures and other non-sapient creatures.

    A member state may be exempt from establishing Reserves within their territory if they negotiate with another member state and the Protection of Animal Welfare Society to safely and securely relocate the magical creatures into a Reserve within said second member state. 

The Protection of Animal Welfare Society is further empowered to do the following:

    Perform periodic, random inspections of Reserves including a review of all records required under Section 4 to ensure compliance.

    Provide monetary support to member states that cannot reasonably be expected to finance it themselves, to create and maintain the Reserves
