[DISCUSSION] All Reference to the Delegate:

This is for organizational purposes. Most of these are paraphrased and I omitted anything that pertains to the extended Executive (Cabinet, EPSA, etc.), isn’t explicitly mechanistic, or isn’t otherwise pertinent.

I’ve highlighted some commentary.

CONCORDAT:

  • Delegate is the executor of Concordat, laws passed by Magisterium, & Conclave orders (this is interesting to think about as a product of the pre-RO era, when the Delegate was literally the only individual capable of enforcement. They essentially still are, given they dole out RO authority, but it’s worth considering that we don’t always have to think this way anymore)
  • Delegate is Registered Voter elected for 4 month term by majority vote of Registered Voters.
  • Delegate shall eject &/or ban nations who have committed summary offense or been sentenced “as such” (ugh) for indicted offense by Conclave. (again, it’s worth thinking about whether we can update this to consider ROs / Administration from Article G or to consolidate anything else)
  • Delegate shall nominate Registered Voters to serve as Arbiters and Viziers; confirmed by Magisterium.
  • Delegate shall not serve concurrently as Magister, Arbiter, or Vizier.
  • Delegate may appoint Ministers to . . . perform nay of the duties of the Delegate, but may only order a Vizier to assume the full Delegacy.
  • “Statutory appointment of [ROs] shall take primacy over discretionary Minister appointments.”
  • Declarations of war are submitted by the Delegate to the Magisterium.
  • Delegate may veto enactment, amendment, or repeal of legislation within ten days of passage or sign it into effect immediately.
  • Delegate may be suspended by 2/3 vote of Magisterium for suspicion of indictable crimes or “abuse of power”, to be lifted by Conclave or majority vote of Magisterium. (so if it narrowly achieves 2/3 majority, the Magis can turn around and vote to lift suspension by the simple majority that was previously achieved…)
  • Delegate actions may be nullified by Conclave for being contrary to Conk / statute.
  • Viziers will remove from power any Delegate suspended by Magisterium or guilty of summary or indictable offense (who decides whether the Delegate is guilty of a summary offense when the Delegate is the one given the authority to punish summary offenses by the Conk?)
  • Praesidium may suspend Delegate via 2/3 majority vote if Delegate has acted to destroy Conk or committed “abuse of power”. Conclave must confirm suspension within 72 hours. Suspension must be prosecuted by Grand Vizier / designee as High Treason or “abuse of power” (?) & shall be lifted by Conclave, 2/3 vote of Viziers, or 4/5 vote of Magisterium.
  • Praesidium shall select Acting Delegate if Delegate is suspended or leaves office; Magisterium may override & select a Vizier of their choosing via majority vote (that seems like a low threshold)
  • All Registered Voters may vote in Delegate elections unless they registered during an ongoing election (can’t vote in that election; can vote later).

DELELEC:

  • “Nominee”: Citizen who has been nominated by oneself or another Citizen; self-noms require another Citizen to 2nd.
  • “Candidate”: Registered Voter who has accepted nomination.

ENDOCAP:

  • “Compliance Officer”: Delegate and any member of EPPS.
  • Delegate must display current endocap # on WFE.
  • Delegate & Viziers are not subject to endocaps.
  • Ejections & bans can be conducted by any Compliance Officer w/ Border Control; influence spending shall be relegated to non-Viziers, “or else to the Delegate”, when reasonable.

EXECUTIVE ACT

  • Cabinet consists of Delegate, RAM, FAM, & any other position defined by law or the Delegate.
  • Delegate can organize Executive ministries, departments, & organizations as they see fit (w/in provisions of Act).
  • Delegate may overrule any Executive appointee’s decisions.
  • RAM and FAM can be removed by 2/3 majority vote by Magisterium for inactivity, high crimes, treason, or inability to perform duties.
  • “[Deputies are defined as Deputy Provosts or appointees to perform duties of Delegate during absence]” (nonsense)
  • Delegate or appointee has authority to grant in-game embassies (doesn’t say close embassies?)
  • Delegate or appointee has authority to approve or deny forum embassy requests (doesn’t say close?)
  • Delegate appoints Chancellor; latter or appointee administers UTEP.

AWARDS ACT:

  • Delegate may award honor to qualifying nation.
  • Delegate may not award honor to nation that had it removed.
  • Delegate or appointee shall create forum thread for Order of the Golden Ocelot.
  • All recipients of the former shall be recorded in thread updated by Delegate or appointee.

PODA:

  • Delegate is Public Official & must maintain disclosure post.
  • Delegate is one of 2/3 officials (+Provost & Viceroy) who can grant permission to withhold a Position of Interest from disclosure.

RMBRA:

  • Delegate “or [ROs]” may suppress, eject, &/or permanently ban Citizens committing Spam, Harassment, or Advertising a Foreign Entity.

EPPS ACT:

  • Copy/pasted “deputies” definition “includes the Deputy Provost and … person(s) who assumes … duties of the Delegate during their absence.” (ffs)
  • EPPS Commissioner may not serve as Delegate (this goes without saying; Conk: Delegate may not serve as Vizier … EPPS Commiss. is Vizier)

EPSA ACT:

  • Delegate, OO, & appointee shall be able to organize EPSA.
  • Delegate may overrule OO & any appointees.
  • Delegate, OO, or appointee sanctions defensive / offensive EPSA ops.
  • Delegate may order mobilization on acts of war passed by Magis.
  • Delegate = highest ranking member; chooses own title. Delegate shall appoint OO; chooses own title.
  • Delegate confirms OO Officer appointments.
  • OO or appointee shall be responsible for enlistment; Delegate can “veto” (improper?) new enlistments.
  • Delegate or OO reserves right to remove EPSA rank from nation serving simultaneously & actively in another military org.
  • Delegate or OO may demote, suspend, &/or expel EPSA members “incapable of conducting themselves appropriately within the Army”.

RO ACT:

  • Delegate appoints ROs in-game.
  • Delegate may utilize / distribute Embassies power at will.
  • Delegate will “by merit” (no sir, I don’t like it; “by nature”, rather) have all RO powers.
  • Delegate-Elect will be given RO position with all RO powers.
  • Current Delegate not reelected must use powers at discretion of Delegate-Elect.
  • Delegate may appoint any Citizen RO & grant any powers defined w/in Act, dismiss RO at any time for any reason, change powers or titles at any time. (insane; potential conflict w/ Designated Viziers but is addressed in 6.5. Could be worded better.)
  • Magisterium may order Delegate to dismiss RO or change RO titles &/or powers by 2/3 majority vote for “inactivity or abuse of power”; changes / removals may be appealed to Conclave.
  • New Delegate may dismiss all ROs at start of new tenure. (potential conflict w/ Designated Viziers but is addressed in 6.5. Could be worded better.)
  • Delegate required to appoint any Vizier designated by Praesidium.
  • Delegate may assign additional powers / titles to Designated Viziers. Magisterium may vote 2/3 majority to change / remove these powers / titles. May be appealed to Conclave.
  • Delegate may only dismiss Designated Vizier as dictated by law &/or SOP. May not dismiss at start of new tenure.
  • Delegate required to appoint Election Commissioner as RO; may not dismiss @ start of new tenure.
  • Delegate may assign EC additional power / title. Magisterium may order change / removal by 2/3 majority vote; may be appealed to Conclave. (but the Conclave (Viceroy) appoints EC…)
  • Individual running for Delegate may not be EC (is this redundant vs. DELELEC?); Viceroy must appoint another individual. If Viceroy is running for Delegate, “Viceroy designee” (?) appoints Commissioner.

TREASON ACT:

  • Attempt to overthrow Delegate = high treason
  • Unlawful act for purpose of overthrowing Delegate = treason

VOTER REG:

  • Delegate cannot serve as Registrar
  • Citizenship held by prohibited individual = summary offense

REG SERVICES & SEC. ACT: not documenting yet; trying to repeal

CONCLAVE ACT: not documenting yet; under Judicial Review

Not sure this is really nessecary to define further, honestly.

Probably the Viziers

I do think we need to update the Concordat with the reality that Viziers now take up a heavy load of enforcement in certain areas alongside the Delegate. I mean, they control the EPPS afterall. But Ig that’s to wait for your vizier review

Shouldn’t be, seeing as the OO is nothing more than a really speciallized Minister. The Delegate should have the authority to override the OO’s appointments, so long as we decide to keep it as essentially a part of the Executive rather than its own entity.
