[PASSED] Repeal: “Freedom of Information Act”

General Assembly Resolution #196 “Freedom of Information Act” (Category: Furtherment of Democracy; Strength: Significant) shall be struck out and rendered null and void.

The General Assembly,

Concerned by the target resolution’s attempts to mandate that member states release any official government records or documents on request or voluntarily,

Acknowledging, nonetheless, that clause 3 contains a glaring flaw, which permits member states to restrict access to certain documents based on “legitimate and non-arbitrary criteria”, an undefined exception allowing governments to restrict access to whatever documents they wish to hide,

Highlighting that clause 4, does not close this loophole, merely requesting that member states censor instead of block the release of restricted documents, which is non-binding,

Confused by clause 5’s requirement to establish a vaguely defined “fair judicial appeals process”, which can simply deny appeals for the same reasons given in clause 3, consequently creating unnecessary bureaucratic load,

Resolving that the aforementioned loopholes create a superfluous resolution, whose mandates are either non-binding, or may be entirely circumvented, thereby serving no purpose to justify remaining as extant legislation,

Hereby repeals GA#196, “Freedom of Information Act”.
