[RESOLUTION PROPOSAL] Attorney Dilemma

Anyways, while this hasn’t been a major problem simply because we rarely have trials, I nonetheless want to bring up the EPAO.

The goal of the EPAO was to create a set of professional attorneys who would aim to fill the need for attorneys whenever a trial arose. Attorneys had to pass a law exam to get the title.

However, the EPAO isn’t really maintained nowadays - which isn’t a big deal in most cases, but is still far from ideal. Best to deal with this now, rather than later.

While the Magisterium can theoretically legislate on this matter, it’s probably best left to the Conclave. What we can do, however, is repeal and replace our own EPAO resolution. Therefore, I have drafted the below and seek comment.

BE IT RESOLVED BY THE MAGISTERIUM OF THE EAST PACIFIC

SECTION I. CITATION

…1.1. This resolution shall be known and cited as the “Resolution on Trial Representation”.

SECTION II. FINDINGS

…2.1. The Eastern Pacific Attorney Office was established by the Conclave in light of the need for a formalized attorney process.

…2.2. This establishment was preceded by a resolution of the Magisterium calling for the same.

…2.3. The Eastern Pacific Attorney Office has not been properly maintained for years, and thus a more simpler system is necessitated.

SECTION III. RESOLUTIONS

…3.1. The Conclave is encouraged to abolish the EPAO.

…3.2. The Conclave is encouraged to create a public list of non-Arbiter Residents willing to serve as representation, which it shall keep available in the Conclave subforums. It is suggested the Viceroy keep this list periodically updated.

…3.3. The Conclave is encouraged to create a set of rules of ethical and professional responsibilities for any individual serving as the private counsel for a party at trial.

My main thought is that every branch should have entry-level positions and that those positions should always have something they could be doing.

You guys should know there’s a proposal on the table within the Conclave to do away with the EPAO and its related administrative rules.

I don’t nessecarily disagree, but I don’t really think the EPAO serves that function well. And for an entry level position, the entry barr is a bit high

Though I think this still has merits because it establishes an alternate (albeit simplistic) system, though ofc the Conclave can ignore the resolution
