SECTION I. CITATION
- This act shall be known and cited as “The Security Act”.
SECTION II. DEFINITIONS
- “Praesidium” – the Security Branch of The East Pacific, consisting of the Viziers and any other organized bodies established by law, Standing Orders, or the Delegate to fulfil the duties of Regional Security.
- “Department” – any organized body of the Praesidium, which may be established, altered, or abolished by the Standing Orders of the Praesidium (SOP) or the Delegate to administer the duties laid out in this Act or the Concordat under the direction of a Vizier chosen by the Delegate; the Viziers shall be organized as a Department and led by the Delegate.
- “The Endorsement Cap” — a cap on the number of endorsements that a resident nation may have in The East Pacific, which shall not apply to the Delegate or the Viziers.
- “Proscription” – a status which confers banishment from the region for reasons of regional security based on actions committed abroad or within The East Pacific.
- “Regional Officer” – an officer designated in-game with any of the powers of Appearance, Border Control, Communications, Embassies, or Polls, with the exception of the Delegate.
SECTION III. ENDORSEMENT CAPS
- The Praesidium shall be charged with setting, altering, and enforcing the endorsement cap.
- The Viziers may set or alter the Endorsement Cap by a 2/3 majority. This cap shall be reasonably set to maintain the security of the Delegacy.
- The Delegate must display the current numerical value of the Endorsement Cap on the Region’s World Factbook Entry.
- Violation of the endorsement cap shall be met with a warning by telegram 24 hours before enforcement action, which may take the form of an unendorsement campaign, ejection, or permanent banishment at the discretion of the Praesidium.
- Enforcement action may be waived if the violator takes reasonable steps to lower their endorsements and poses no immediate threat.
SECTION IV. REGIONAL OFFICERS
- The Delegate shall be charged with appointing all Regional Officers designated by the Concordat or Statutory Law.
- The Delegate shall appoint three Viziers to Regional Officer positions with Appearance, Border Control, and Communications powers and designated with the title Vizier.
- The Delegate shall appoint the Archon with all powers except Border Control.
- The Delegate shall not utilize their on-site authority to construct or abolish any embassy, nor shall they grant embassy powers to anyone without the approval of the Archon.
- The Border Control power may only be granted to Viziers or Regional Officers ordered by the Administration’s Regional Administrative Office.
- Viziers who enter the in-game Delegacy accidentally shall work to restore the in-game Delegacy to the duly elected and confirmed Delegate.
- The Magisterium may, by a 2/3 majority vote, order the removal of a Regional Officer other than the Archon for any period of time up to and including a year. If they order the removal of a Vizier, another Vizier must be appointed in their place.
- The Conclave may dismiss any Regional Officer through trial verdict. If they order the removal of a Vizier, another Vizier must be appointed in their place.
- The appointment of any Regional Officer with the title of Vizier or Archon who does not lawfully hold such office shall be an indictable offense.
- The Delegate and Regional Officers must comply with all requests for region-wide telegrams submitted by the Election Commission which align with the duties of the Election Commission. Candidates for Archon may not send out such telegrams or advertise the elections or their candidacy in any way utilizing their Regional Officer authority.
SECTION V. PROSCRIPTIONS
- The Praesidium shall be charged with instituting, altering, or lifting proscriptions on organizations or individuals hostile to The East Pacific and its interests. This power shall belong solely to the Department of the Viziers.
- Proscriptions shall be issued or altered through a 2/3 majority vote of the Viziers, with an announcement to the public detailing the provisions of the proscription, which shall name the individuals, regions, or organizations proscribed, and explain the justification for the proscription or its alteration.
- No citizen may be proscribed by the Praesidium.
- A public list of proscriptions shall be created by the Delegate or any appointee thereof in the Praesidium subforum.
SECTION VI. CRIMINAL INVESTIGATION AND PROSECUTION
- The Praesidium shall be charged with investigating and prosecuting crimes against The East Pacific in the Conclave. This task may be separated into two separate Departments by the discretion of the Praesidium.
- Prosecution may only be initiated upon a simple majority vote of the Viziers or any other Department tasked with prosecution.
- Investigation may involve liaising with interregional officials, the solicitation of witness testimony, and the gathering of photographic evidence in all avenues available to members of the Praesidium.
- Evidence of a crime shall not be subject to protection by treason-espionage laws unless the information contained within could endanger regional security.
- Confidentiality of witnesses and evidence sources shall be maintained when deemed appropriate by the Praesidium.
SECTION VII. INTERBRANCH COLLABORATION
- Any information received by any officer of The East Pacific which concerns the regional security of The East Pacific shall be immediately delivered to the Praesidium.
- The Praesidium shall be informed beforehand of all infiltrations and foreign intelligence-gathering operations conducted by the Executive branch, and given monthly updates until the conclusion thereof.
- The Praesidium may decide what information is safe and legal to share to the public in any situation concerning the regional security of The East Pacific.
SECTION VIII. REPEALS
- The Endorsement Caps Act is repealed upon the enactment of the Security Act.
- The Regional Officers Act is repealed upon the enactment of the Security Act.
- The Eastern Pacific Police Service Act is repealed upon the enactment of the Security Act.
- Section VI of the Citizenship Act shall be struck from law upon the enactment of the Security Act.
- Section VIII of the Security Act shall be struck from law as a discretionary amendment upon the effectuation of these provisions, since such an act shall not change the meaning or provisions of the law due to the irreversible provisions contained within.
