[REPEAL] Conclave Orders Act

My fellow Magisters,

Relatively recently, AMOM requested a Judicial Review regarding the Conclave Orders Act, seeing it potentially unconstitutional. I, myself, see it as unnecessary clutter more than anything else - I believe the Conclave is quite capable of managing themselves. To me, this looks like more rules that need to be followed that then need to be enforced… it’s just a headache. The Conclave knows how Conclave business works; I’m of the opinion that things of this nature are best kept to that body’s Standing Orders. (This is also true of the Law Standards Act in relation to this fair Magisterium.)

Thus, I propose we repeal the Conclave Orders Act in an effort to reduce legislative clutter.

The Conclave Orders Act is meant to stop the Conclave from being able to wield a broad abusable power however it wants. A Conclave Order allows the Conclave to effectively initiate a trial against anyone for anything. It’s too broad of a power if we just use the Concordat; therefore, it must be regulated by law.

My main fear with Orders is that they could easily be used as a tool of acute chaos by a stacked Conclave in a potent time of crisis. A theoretical example of such a time would be the exact day of Fedele’s coup. Imagine if the coupers had the power to use Orders as they wished if they had stacked the Conclave? It certainly wouldn’t have helped anything, even if we would eventually remove them as Arbiters and even if theyd have to do a trial first to ban their enemies in such a scenario. Would we like that to be a possibility?

This function of the Act isnt something that can be just put into the SOC, because that defeats the entire purpose of the Act if the Conclave can decide on its own how it wishes to use its Order powers.

Conclave Orders are a rarely used power that could be fine if they were an implied power, so I (even though Im the Act’s author!) would be conpletely fine with repealling this Act on one condition: amend the Concordat to remove the Conclave’s power to grant Orders. Otherwise, I staunchly oppose this repeal and will encourage all Mahisters to do the same.

Additionally - should this Act be repealled, I will be proposing a Concordat amendment to remove Conclave Orders.

In light of:

  1. a brief personal review of the Concordat confirming that we are in fact allowed to do this,
  2. Zukchiva’s argument in favor of the Act, and
  3. a private conversation mostly regarding point #1,

I am standing down. This was a move entirely based in impatience and a misunderstanding of the current TEP political climate on my part. I thought the whole thing overdone- this is my mistake, and checks and balances are being applied properly.

This is what happens when you have a government bureaucrat try to do legislative work.

I apologize to the Magisterium and warn you all that this will happen again, likely in the next few weeks.

Can we partake in the benefits of the “private conversation”, or do we need to guess as to what the good arguments might have been?

I don’t think a conversation with AMOM telling me it’s probably best to admit I was wrong and move on is particularly notable.
